Under the recent revisions to the bankruptcy laws, you must now qualify to file for protection under Chapter 7 of the federal bankruptcy laws by submitting to a "means test." If you demonstrate that you have the ability to repay your creditors over a 3 to 5 year period, you will not be able to seek protection under Chapter 7, but will have to use Chapter 13 to get a fresh financial start.
